Petitioner is accused in connection with Jainagar P.S. Case No. 37 of 2015 registered under Sections 147, 148, 149, 34, 323, 307, 302 of the I.P.C. and 27 (3) of the Arms Act. Accusation is that at the time of occurrence, petitioner along with six others attacked on the informant Radhe Kumar Yadav, his father Chalitar Yadav and uncle Sonfil Yadav, in that course, Digamber Yadav shot fired causing death of Chalitar Yadav. Sanjay Yadav also shot fired on Sonfil Yadav, who fell down, at that time, petitioner and Ram Kumar Yadav said to have caused fracture injury at the hand of Sonfil Yadav, who died.
Learned counsel appearing on behalf of the petitioner submits that while allegation has been made against Ram Kumar
Patna High Court Cr.Misc. No.23245 of 2015 (4) dt.12-08-2015 2/2 Yadav @ Bula to cause fracture injury at the hand of the deceased Sonfil Yadav, uncle of the informant, but Ranjit Yadav, son of Sonfil Yadav and Sarita Devi in their statement in paragraph nos. 14 and 17 have stated that fracture injury was caused by only Ram Kumar Yadav @ Bula. It is also submitted that petitioner, having no criminal antecedent, is in custody since 07.03.2015. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Madhubani in connection with Jainagar P.S.
