The petitioner is languishing in custody since 21.03.2014 in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

The accusation is of committing dacoity in the house of the informant when gold ornaments worth Rs.80,000/- were being robbed.

It is submitted by learned counsel for the petitioner that there is no recovery from the possession of the petitioner nor the petitioner has been put on TIP. Statement to that effect has been made in para 5 and 6 of the petition. Though the petitioner is accused in two other cases.

Patna High Court Cr.Misc. No.24468 of 2014 (03) dt.08-01-2015 2/2 Considering the fact that the petitioner was not put on TIP nor named in the FIR, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Pali P.S. Case No. 25 of 2013. The learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
