The petitioner seeks pre-arrest bail in connection with Sherghati (Dobhi) P.S. Case No. 352 of 2017 registered for the offences punishable under Section 409 read with 34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that there is no truth behind the allegations made in the first information report that the petitioner misappropriated Rs. 13,747.06/-. As a matter of fact, the first information report has been instituted by the informant merely on hypothetical presumption and wild suspicion. Even otherwise, the petitioner has deposited Rs.13,747/- on 28.11.2018 in Account No. 1967000102525550 and the District Programme Officer, Gaya has issued a memo on 01.12.2018 as contained in Annexure-2 to

Patna High Court Cr.Misc. No.2741 of 2019(2) dt.22-01-2019 2/2 this application.

Learned counsel for the State opposed the application for grant pre-arrest bail to the petitioner.

Considering the nature of allegation and the submissions made above, in the event of arrest or surrender in the court below, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sherghati at Gaya in connection with Sherghati (Dobhi) P.S. Case No. 352 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
