The petitioner seeks bail in connection with Basopatti P.S. Case No. 217 of 2021 instituted for the offences under Sections 272 and 273 of the Indian Penal Code read with Section 30(a) of the Bihar Excise Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 24.12.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the allegation is of recovery of 153 litres of liquor from Brahm Asthan.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.5974 of 2022(2) dt.08-03-2022 2/2 petitioner was not arrested from the spot and his name transpired in the secret information received by the police. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody, is a person with clean antecedent, charge-sheet has been submitted in the case and he was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Madhubani in connection with Basopatti P.S.
