JUSTICE AMARESH KUMAR LAL ORAL ORDER 11-08-2015 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks bail in a case registered for the offence punishable under Sections 414, 467, 468 and 471 of the Indian Penal Code.
The allegation is that on getting information that the veteran criminal Ramchal (petitioner) has come to his house and he is likely to commit another offence, the police personnel went to the house of the petitioner. After seeing the police, the petitioner was escaping, but he was apprehended in courtyard. On search of his person, a mobile was recovered and a T.V.S. Motorcycle was also recovered from his courtyard. The number plate of the motorcycle was tried to deface.
It is submitted that the mobile phone belongs to the petitioner and the motorcycle has not been recovered from the
Patna High Court Cr.Misc. No.24617 of 2015 (2) dt.11-08-2015 2/2 courtyard and not from his possession. He has criminal antecedents in which he is on bail. He is in custody since 6.02.2015. After investigation, charge sheet has already been submitted. The learned counsel for the State submits that the petitioner has also criminal antecedents.
Considering the facts and circumstances of the case, let the above-named petitioner be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea/court concerned after framing of charge in Bhawanipur P.s. Case No.29 of 2015 with the following conditions :
1.
One of the bailors will be the close relative of the petitioner.
2.
The petitioner will not indulge in similar or in any other offence.
3.
The petitioner will be well represented in the court.
4.
In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
