The petitioner seeks regular bail in connection with Sakra P.S. Case No.452 of 2021 lodged under Sections 272, 273, 414/34 of the Indian Penal Code read with Section 30(a),37 (b)(c) of Bihar Prohibtion and Excise Amendment Act, 2018. As per the allegation made in the F.I.R., the total recovery of 1164.825 liters of foreign liquor were made in this case.
Learned counsel for the petitioner submits that charge sheet has already been filed in this case and petitioner is in custody since 15.09.2021 having no criminal antecedent. He further submits that other co-accused persons namely, Shiv Kumar and Sanjeev Kumar were granted bail by the Co-ordinate
Patna High Court CR. MISC. No.5018 of 2022(2) dt.09-06-2022 2/2 Bench of this Hon'ble Court vide order dt. 21.12.2021 and 30.05.2022 in Cr. Misc. No.66300 of 2021 and 191 of 2022 respectively.
Learned A.P.P. has opposed the prayer for bail. Considering the facts of the case and after perusal of records as well as this aspect that charge sheet has already been submitted and petitioner is in custody since 15.09.2021 having clean antecedent and bail has been granted to accused persons by the Co-ordinate Bench of this Hon'ble Court, let the petitioner above named, be granted bail on furnishing bail bond of Rs.50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Sakra P.S. Case No. 452 of 2021.
