Petitioner is said to have been caught on the date of the occurrence along with other accused but admittedly, nothing was recovered from the possession of the petitioner. Moreover, co-accused Biru Gwala, from whose possession looted money was recovered, has already been granted privilege of bail by a coordinate bench of this court.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Riga P.S. Case no. 40/2015.
