The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504 and 506 of the Indian Penal Code. The prosecution case is that one Rambhajan Rai intoxicated condition abused the mother-in-law of the informant and subsequently the petitioners and others assaulted the informant, her husband and Chinta Devi.
It is submitted by learned counsel for the petitioners that the accusation is omnibus and general and coaccused Deepan Ram has sustained head injury. All the injuries of the informant side have been found to be simple in nature.
Patna High Court Cr.Misc. No.15184 of 2016 (2) dt.12-04-2016 2/2 The informant has subsequently retracted from the initial version and filed a petition to that effect before the learned court below. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail provisionally for three moths, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (M) P.S. Case No. 147 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
The provisional bail of the petitioners will be confirmed by the learned court below if none received any grievous injury, but in case anyone received grievous injury then the petitioners will surrender and pray for regular bail. (Dinesh Kumar Singh, J) DKS/- U T
