1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Goh Police Station Case No. 144 of 2023, dated 25.04.2023, disclosing offence under Section 379 of the Indian Penal Code.

3. The prosecution case, as per the First Information Report, is that the informant, on 24.04.2023, at about 11:30 AM, went to Shanti More, Goh, for some work and parked his motorcycle near Yatri Shed and when he returned back, he found his motorcycle missing.

4. Learned Counsel for the petitioner submits that the First Information Report has been registered against unknown. He further submits that the petitioner is innocent and has

He further submits that during investigation, two persons, namely, Subham Kumar and Ravi Ranjan Kumar, were arrested and on the basis of their confessional statements, the name of the petitioner has transpired in this case. He further submits that the petitioner has got no criminal antecedent.

Regards being had to the submission advanced on behalf of the parties concerned and taking into consideration the fact that the petitioner has got no criminal antecedent and his name transpired in this case on the basis of confessional statement of the arrested co-accused persons, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Daudnagar, Aurangabad, in connection with Goh Police Station Case No. 144 of 2023, subject to the condition laid down under Section 438 (2) of the Code of
