The petitioner is apprehending arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

It is alleged that one Samsung duel SIM mobile of the informant was stolen from the waiting room of Patna junction leading to registration of FIR against unknown. During investigation, the name of the petitioner sprang up. It is submitted by learned counsel for the petitioner that only on suspicion the petitioner has been roped in the present case and there is no recovery from the petitioner. The aforesaid facts constitute ground for consideration of prayer for regular bail.

Patna High Court Cr.Misc. No.14169 of 2016 (2) dt.31-03-2016 2/2 Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with G.R.P. Patna P.S. Case No.28/2014, pending before the Railway Judicial Magistrate, Patna.

With the above observation, this application is, accordingly, disposed off.
