The petitioner seeks bail in Special Case No.158 of 2020, arising out of Rail Patna Junction (Rajendra Nagar) P.S. Case No.166 of 2020, registered for the offences punishable under Sections 20 and 22 of the NDPS Act.

As per the prosecution case, the petitioner was apprehended on the spot with another person and from possession of his companion, 10.200 kilograms of Ganja was recovered. From possession of the petitioner, used clothes, one mobile of Samsung Company, Rs.500 cash and identity card were recovered.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. No

It is further submitted that the person, from whose possession contraband article was recovered, has been granted bail by a co-ordinate Bench of this Court vide order dated 06.07.2021, passed in Cr. Misc. No.9839 of 2021. The petitioner is in custody since 13.11.2020. Considering the fact that no contraband article has been recovered from conscious possession of the petitioner, let petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Session Judge cum Special Judge, Patna in connection with Special Case No.158 of 2020, arising out of Rail Patna Junction (Rajendra Nagar) P.S. Case No.166 of 2020.
