The petitioner seeks bail in Sessions Trial No. 736 of 2014, arising out of Pakaridayal P.S. Case No. 59 of 2014, registered for the offences punishable under Sections 366 (A) and 34 of the Indian Penal Code.

The allegation against the petitioner is that the petitioner along with others kidnapped the victim. The petitioner was apprehended by the police thereafter the victim was recovered. Prayer for bail of the petitioner was earlier rejected vide order dated 20.04.2015 passed in Cr. Misc. No. 42540 of 2014 with a direction to expedite the trial and conclude the same within six months from the date of receipt of this order. It is submitted that learned 1st Additional Sessions Judge, East Champaran, Motihari has stated in his order that charges were framed but not a single witness has been examined. Considering the facts aforesaid and the fact that the petitioner is in jail since 24.04.2014 and has already remained in jail for more than two years and four months, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge, East Champaran, Motihari in Sessions Trial No. 736 of 2014, arising out of Pakaridayal P.S. Case No. 59 of 2014.
