The petitioner is apprehending his arrest in connection with Rudrapur P.S.case No.98 of 2018 corresponding to G.R.No.1582 of 2018 , registered for offences punishable under Section 7 of the Essential Commodities Act..
One Shri Ram Yadav was arrested along with 200 ltrs. of kerosene oil, which is said to have been purchased from the petitioner, who is a PDS Dealer.
Submission of the learned counsel for the petitioner is that there is no shortage in the register of the petitioner and he has been falsely implicated in this case and ready to abide by any condition imposed upon him. Heard learned A.P.P. also. Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named,
Patna High Court Cr.Misc. No.3675 of 2019(3) dt.22-02-2019 2/2 in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Jhanjharpur District Madhubani in connection with Rudrapur P.S.Case no.98 of 2018 G.R.No.1582 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid observation, this application is allowed.
