Petitioner is accused in connection with Sanokhar P.S. Case No. 69 of 2012 registered under Sections 302, 328, 34of the I.P.C.

Accusation is that due to dispute in between the petitioner and his own brother, Raj Kumar Singh, their mother, wife of the informant, made interference, in that course, petitioner started to abuse and assault her. In the meantime, Ranjana Devi, wife of the petitioner, came with poison in bottle and gave to the petitioner then petitioner administered to her mother (informant's wife). When the informant, father of the petitioner, came at his house, he was also assaulted by the petitioner and his wife and the matter was pacified by the neighbour and wife of informant, was

Learned counsel appearing on behalf of the petitioner submits that no any external injury was found on the person of the deceased, mother of the petitioner (wife of the informant). In fact, due to partition of agricultural land, dispute took place in between petitioner and his brother Raj Kumar Singh. In that course, mother of the petitioner, who used to reside with Raj Kumar Singh came and gave threatening not to quarrel each other but quarrel was going on and due to that reason, she consumed poison herself. The Police after investigation has submitted charge-sheet under Section 306/34 of the I.P.C. It is also submitted that petitioner is in custody since 19.01.2015.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Bhagalpur in connection with Sanokhar P.S.
