The petitioner has renewed his prayer for grant of regular bail in a case registered under sections 25(1-B)(a), 26 and 35 of the Arms Act and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, a loaded country-made pistol with four live cartridges and 147.75 litres of IMFL was recovered.

It is submitted by learned senior counsel appearing for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 8.7.2021 (Annexure-1) passed in Cr. Misc. No. 8352 of 2021 giving liberty to the petitioner to

Patna High Court CR. MISC. No.4425 of 2022(2) dt.02-02-2022 2/2 renew his prayer for bail after six months. It has been more than six months since passing of the said order.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the liberty granted in the aforesaid order of rejection dated 8.7.2021 and the petitioner having remained in custody for more than 1 year 4 months, the petitioner is directed to be enlarged on bail in connection with Excise Case no. 633 of 2020 (arising out of Madhepura P.S. Case no. 731 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Madhepura.
