====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 25-01-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

In this case, the petitioner is seeking anticipatory bail in connection with Chandpura P.S. Case No. 4 of 2016 registered for offence punishable under sections 467, 468, 470, 471, 406, 420/34 of the Indian Penal Code.

Allegation has been made that fraudulently by place the forged document of rent receipt and other connecting documents, the petitioner obtained the loan under the K.C.C. Scheme of Rs.77,591/- and it was informed to the Bank that she obtained the loan in a fraudulent manner and it has been confirmed by the Circle Officer, Begusarai.

Patna High Court Cr.Misc. No.3423 of 2019(2) dt.25-01-2019 2/2 The learned counsel for the petitioner submits that the petitioner has already deposited Rs.79,100/-. Considering the facts and circumstances of the case, the petitioner in the event of arrest or surrender before the court below within six weeks from today, is directed to be enlarged on provisional bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate-VI, Begusarai in connection with Chandpura P.S. Case No. 4 0f 2016, subject to the conditions as laid down under section 438 Cr.PC and also condition that her bail will be only confirmed after verification as to whether she has deposited the entire loan amount along with interest.

If there is some deficit, she will have liberty to deposit the rest amount. Further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make herself available as and when required by the court.
