JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 364, 120B/34 of the Indian Penal Code.

Petitioner and co-accused, Dinesh Mahto took the victim from his house and after that victim did not return to his home. However, co-accused, Dinesh Mahto, having similar allegation, has already been granted privilege of bail and it appears that except the aforesaid material, nothing came against the petitioner in course of investigation.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.14036 of 2016 (2) dt.05-04-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-III, Begusarai in connection with Sessions Trial No. 150 of 2016 arising out of Sahebpur Kamal P.S. Case No. 170 of 2015.
