The petitioner is in custody in connection with Taraiyan P.S.Case No.169 of 2014 pending in the Court of CJM, Saran for an offence registered under Sections 304(B), 201 and 34 of the IPC.
As per the prosecution case, it is a case of murder of informant's married sister by the accused persons due to nonfulfilment of demand of dowry. Petitioner is in custody since 08.07.2015. Chargesheet has been submitted in the case. Petitioner has got no criminal antecedent. There is no allegation of tampering of evidence against the petitioner. Petitioner has been made accused due to
Patna High Court Cr.Misc. No.14239 of 2016 (6) dt.19-07-2016 mistake of fact. Petitioner after the death of his wife had intimated the informant regarding the death of the deceased. On behalf of the State, it has been submitted that the petitioner is named in the FIR and he is the husband of the deceased. The dead body has not been recovered. Considering the aforesaid facts and circumstances, I am not inclined to release the above named petitioner on bail, the same is rejected.
Anyhow, the trial Court is directed to take all necessary steps to expedite the trial.
