JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-414/34 of the Indian Penal Code.

Petitioner was arrested on the basis of disclosure, made by co-accused and, one motorcycle is said to have been recovered from conscious possession of the petitioner and at the time of his arrest, the petitioner disclosed that the aforesaid motorcycle has been given to him by Wasim Alam. The petitioner is languishing in jail custody since the day of his arrest and, does not have any criminal antecedent.

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten

Patna High Court Cr.Misc. No.14011 of 2016 (2) dt.05-04-2016 2/2 thousand) with two sureties of the like amount each in connection with Kutumba P.S. Case No. 12 of 2016 to the satisfaction of Sri Sanjeev Kumar, learned Judicial Magistrate-Ist Class, Aurangabad.
