That this is an application for issuance of an appropriate writ, order, direction quashing the notice dated 25.4.2017 issued by the Circle Officer, Chiraiya whereby the petitioner has been directed to remove encroachment from 111⁄2 dec. land of Khata no. 215, Plot no. 1427, Mauza Baidyanathpur over which part of his house is situated but without asking any show cause to the petitioner, who himself was complainant, and without initiating
Patna High Court CWJC No.7302 of 2017(2) dt.17-04-2023 2/2 proceeding under the Bihar Public Land Encroachment Act, he has been directed to remove encroachment on the basis of wrong report of Amin."
Considering the nature of relief sought for in the present writ petition, I deem it fit and proper to grant liberty to the petitioner to approach the respondent-authorities for redressal of his subsisting grievance, if any.
Accordingly, the present writ petition stands disposed off on the aforesaid terms.
