In this case, petitioners are seeking bail in Buxar (T) P.S.Case No. 118 of 2015 registered u/s 147, 148, 149, 341, 386, 379, 337, 323, 436, 307, 332, 353, 427 IPC.

As per FIR large number of persons had resorted to vandalism, ransacked the Police Station, assaulted Police Personnel and badly damaged the Government property. Counsel for the petitioners submits that there is no specific allegation against the petitioners. They were members of the mob. Co-accused Manoj Rai and others have been granted bail by this Court vide Cr. Misc.No. 17570 of 2015 and other analogous cases.

Looking to the nature of allegation, petitioners (1) Anis Raeen @ Anis Faruqui and (2) Baber Khan are directed to be

No.24482 of 2015 (2) dt.18-06-2015 2/2 released on bail on his furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Buxar (T) P.S.Case No. 118 of 2015, subject to the conditions that:

(i) one of the bailors will be a close relative of each of the petitioners, (ii) if the petitioners would be found involved in similar type of case in future, prosecution will be at liberty to file application for cancellation of bail and the court below will pass necessary order, including cancellation of bail bonds and (iii) the petitioners would co-operate and if the petitioners will fail to co-operate in the proceeding of the court and will remain absent for two consecutive dates without reasonable explanation, the court will pass appropriate order, including cancellation of bail bonds.
