Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 01.08.2018 passed in Cr. Misc. No.44712 of 2018 and the allegation against the petitioner is that they chased the deceased and made indiscriminate firing. Submission of the learned counsel for the petitioner is that the specific allegation is against the co-accused persons and he is in custody since 27.5.2018 and up-till-now there is no progress in the trial. .

Heard learned A.P.P. and from perusal of the record it appears that the charges have been framed and up till now three prosecution witnesses have been examined and that shows that the trial is going on.

In such view of the matter, I am not inclined to

Patna High Court CR. MISC. No.15802 of 2019(3) dt.17-04-2019 2/2 grant bail to the petitioner and the learned trial court is directed to expedite the trial.

With the aforesaid direction, this application is dismissed.
