The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code.
The petitioner is not named in the FIR. The case was lodged against unknown after recovery of the dead body. The widow of the deceased disclosed that her husband had gone along with Yogendra Madhesiya and Subhash Tiwari as a party was held with the joint fund of the deceased and Yogendra Madhesiya and Subhash Tiwari. Subhash Tiwari confessed his guilt and disclosed the name of the petitioner. Yogendra Madhesiya also confessed his guilt and disclosed the name of the petitioner as one of the persons who killed the deceased as the petitioner had illicit
Patna High Court Cr.Misc. No.23200 of 2015 (3) dt.22-09-2015 2/2 relation with sister-in-law (bhabhi) of the deceased and the deceased was objecting. Save and except confession of co-accused the I. O. did not collect any further tangible evidence. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bagaha, West Champaran in Dhanaha P.S. Case No. 165 of 2014.
