JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are languishing in custody since 12.1.2015 in a case registered for the offences punishable under Sections 147,148,149,323,324,325,452,366A and 379 of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant and taking away the house hold articles. It is submitted by the learned counsel for the petitioners that in 164 Cr.P.C. statement the victim has got her age recorded as 19 years when the court assessed her as 16 years where she stated that she of her own has married with Sohit and residing at

Patna High Court Cr.Misc. No.23183 of 2015 (3) dt.13-07-2015 2/2 Delhi with him. It is further submitted that the petitioners have been roped in the present case since they happen to be the brothers of Sohit.

Considering the statement of victim under section 164 Cr.P.C., let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sitamarhi in connection with Bajpatti P.S.
