The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Choraut P.S. Case no. 15 of 2021 instituted for the offence under Sections 363, 366(A)/34 of the Indian Penal Code. Prosecution case relates to abduction of daughter of the informant. On the basis of strong suspicion, informant has named the petitioner.
Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. There is a delay of more than a week in lodging the
Patna High Court CR. MISC. No.4955 of 2022(2) dt.02-08-2022 2/3 FIR, which falsify the prosecution story. Statement of the victim girl u/s 164 Cr.P.C. has got been recorded in which she has stated that out of her own sweet will, she went to her relatives house due to ill behavior of her parents. The same fact is mentioned in the impugned order.
Learned APP appearing for the State has opposed the prayer of Bail.
Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Choraut P.S. Case no. 15 of 2021, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge, 6th, Sitamarhi subject to the conditions as laid down under section 438(2) of the Cr.P.C.
