JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 395 of the Indian Penal Code.

Petitioner is not named in the first information report nor anything appears to have been recovered from his conscious possession. Petitioner is in jail custody since 24.4.2015, but he was not put on Test Identification Parade. It would appear from the impugned order that learned court below rejected the prayer for bail of the petitioner only on the ground that petitioner does have criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named

Patna High Court Cr.Misc. No.14748 of 2016 (2) dt.08-04-2016 2/2 be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Aurangabad in connection with Nabinagar P.S. Case No.201 of 2010.
