JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 414, 399, 402, 120B/34 of the Indian Penal Code.
Petitioners and one other accused were caught on the spot whereas some co-accused managed to escape and on being searched, mobile sets, cash and A.T.M. cards were recovered from possession of petitioner no. 2 whereas nothing was recovered from possession of petitioner no. 1. One motorcycle was also seized from the place of occurrence.
Patna High Court Cr.Misc. No.14400 of 2016 (2) dt.07-04-2016 2/2 Submission on behalf of the petitioners is that the aforesaid motorcycle belongs to petitioner no. 1, who had purchased the said motorcycle from one Mahesh Rai and moreover, petitioners do not have any criminal antecedent and have been implicated in this case on mere suspicion. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Chhatauni P.S.
