The petitioner seeks regular bail in connection with Bairgania P.S. Case No. 201 of 2018, registered for the offence punishable under Sections 302, 201 and 120B/34 of the Indian Penal Code.

The allegation is regarding the marriage of the deceased sister of the informant having taken place ten years back and on account of being subjected to torture and abuse by her-in-laws, it is alleged that the sister of the informant was killed by her-in-laws.

The learned counsel for the petitioner submits that three children were born out of the wedlock and the petitioner is residing separately with his wife and is in no manner

Patna High Court Cr.Misc. No.2616 of 2019(2) dt.21-01-2019 2/2 connected with the deceased daughter-in-law as such the wife of the petitioner has also been granted regular bail by this Court by an order dated 09.01.2019 passed in Criminal Miscellaneous No. 79561 of 2018. The petitioner is stated to the father-in-law of the deceased lady. It is submitted by the learned counsel for the petitioner that the petitioner is having clean antecedent and he is languishing in custody since 29.08.2018.

Having regard to the facts and circumstances of the case and also the fact that similarly situated co-accused person has been allowed bail by this Court, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Bairgania P.S. Case No. 201 of 2018.
