JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. On the basis of recovery of unknown dead body from canal on the basis of written information given by the Chaukidar Mushari P.S. Case No.156/15 corresponding to Sessions Trial No.100 of 2016 was instituted on 19.9.2015 under Sections 302 and 201/34 of the I.P.C..
Learned counsel for the petitioner submits that in course of investigation dead body was identified as husband of the petitioner. The petitioner is the second wife of the deceased. The marriage of the petitioner was performed with the deceased after death of first wife with whom the deceased had one son, namely Rakesh Kumar who in course of investigation raised suspicion
Patna High Court Cr.Misc. No.16065 of 2016 (3) dt.20-05-2016 2/2 against the petitioner having hand in present case. He further submits that the petitioner being a lady is in custody since23.9.2015 having no criminal antecedent. Having regard to the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the 13th Additional Sessions Judge, Muzaffarpur, in Sessions Trial No.100 of 2016 arising out of Mushari P.S.Case No.156/15.
