JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2015 The petitioner is languishing in custody since 09.04.2015 in connection with Dehari Town P.S. Case No. 53 of 2015 for the offences instituted under Sections 392 and 120(B) of the I.P.C.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that on 08.02.2015 the informant was returning to home rom Kali Ashthan. Rajputan Mohalla. Dehri, after offering prayer and at some distance from Kali Asthan at 1.30 P.M. three young men riding on a black colour motorcycle stopped near the informant and snatched her golden chain weighting 15 Grams and Mangal Sutra weighting 4 Grams and the culprits fled away towards Pani Tanki and the informant raised alarm but the culprits succeeded in fleeing away from scene

It has been submitted on behalf of the petitioner that the petitioner is not named in the F.I.R. Further it has been submitted that the petitioner has got no criminal antecedent. Further it is pointed out that there is no recovery of any indiscriminating article from possession of the petitioner nor the petitioner has been put on T. I. Parade. It is further submitted that the petitioner is in custody since 09.04.2015 as it is evident from Annexure-1 to the present application. It is further submitted that the petitioner may be released on bail after completion of six months in custody. On behalf of the State, it has been submitted that the name of the petitioner has appeared in the present case in course of investigation.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail after completion of six months in custody from 09.04.2015 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Dehri, Rohtas at Sasaram, in connection with Dehri Town P.S. Case No. 53 of 2015.
