While deceased Kameshwar Singh @ Ram Babu Singh was at temple along with three more persons, Deep Narayan Mandal watched his presence and then, thereafter, Sanjay Mandal, Sujay, Vijay, Ramdeo came and on an order of Sanjay Mandal, Sujay shot at whereupon his father raised alarm that Sujay shoots. Informant along with others present nearby, rushed but the accused persons threatened them and in the aforesaid background succeeded in their escape. Deceased was lifted to local hospital and then to PMCH where, as is evident from the order impugned, died.

Petitioner is not named in the FIR. There happens to be specific disclosure regarding assailant. From the order impugned, it is apparent that his status has been identified as was actively involved.

No.23407 of 2015 (2) dt.10-07-2015 That being so, petitioner Raman Jha @ Chhote Jha is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Ad-hoc Additional Sessions Judge, 1st, Sitamarhi in connection with Sessions Trial No.470 of 2011 arising out of Bathnaha P.S. Case No.74 of 2009. (Aditya Kumar Trivedi, J.) PN/- U T
