The petitioner seeks bail in Madhepura (Bharahi) P.S. Case No. 437 of 2014, registered for the offences punishable under Section 394 of the Indian Penal Code.

The petitioner was found using his SIM in the looted Nokia mobile. The SIM was issued in the name of Rekha Devi, sister-in-law of the petitioner and consequently the mobile was also recovered from possession of the petitioner. Prayer for bail of the petitioner was earlier rejected vide order dated 29.09.2015 passed in Cr. Misc. No. 22020 of 2015 with liberty to renew his prayer for bail after remaining one year in custody.

Since the petitioner is in jail since 26.03.2015 and the

Patna High Court Cr.Misc. No.15296 of 2016 (2) dt.31-08-2016 2/2 petitioner has already remained in jail for more than 1 1⁄2 years, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura in Madhepura (Bharahi) P.S. Case No. 437 of 2014.
