JUSTICE SUDHIR SINGH ORAL ORDER 12-08-2015 The petitioner is languishing in custody since 21.03.2015 in connection with Ramgarhwa P.S. Case No. 53 of 2014 for the offences instituted under Section 395 of the I.P.C. Heard learned counsel for the petitioner and learned counsel for the State.

The accusation is of robbing the truck loaded with grocery goods of the informant by the accused persons. It has been submitted on behalf of the petitioner that the petitioner is in custody since 21.03.2015 and the charge sheet has been submitted in the present case. It is further submitted that the petitioner is not named in the F.I.R. In T.I. Parade, the petitioner has not been identified. There is no recovery of any incriminating

Patna High Court Cr.Misc. No.23438 of 2015 (3) dt.12-08-2015 2/2 article from possession of the petitioner. It is further submitted that the petitioner may be released after completion of eight months in custody from 21.03.2015.

On behalf of the State it has been submitted that the petitioner has criminal antecedent.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail after completion of eight months in custody from 21.03.2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Raxaul at Motihari, East Champaran, in connection with Ramgarhwa P.S. Case No. 53 of 2014.
