The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504, 506, 34 of the Indian Penal Code and Section 27 of the Arms Act. It is alleged against the petitioners that on the order of petitioner No. 2, co-accused Pinkesh Singh fired

Patna High Court CR. MISC. No.4613 of 2022(3) dt.26-07-2022 2/3 at the son of the informant as a result of which, he sustained gunshot injuries on his abdomen. It is alleged against petitioner Nos. 1 and 3 that they assaulted with garasa on the head of son of the informant.

It is submitted by learned counsel for the petitioners that petitioners have falsely been implicated in this case. There is counter version of the occurrence also and petitioners' side also received injuries. Learned A.P.P appearing for the State has vehemently opposed the prayer for anticipatory bail of the petitioners and submitted that the independent witnesses have supported the prosecution case. From perusal of the injury report, it appears that the injuries were caused to the informant on the vital part of his body. The injury report also corroborates the version of the prosecution.

Considering the facts stated above, this Court is not inclined to enlarge the petitioners on anticipatory bail.

The petitioners are at liberty to surrender before learned Court below and pray for regular bail. The learned Court below may consider the prayer for regular bail of the petitioners, without being prejudiced by the order of this Court and in accordance with law. (Sunil Kumar Panwar, J) Shageer/- U T
