Petitioner apprehends arrest in a case registered for the offence punishable under sections 448/341/323/307/379/354/504/506/34 of the Indian Penal Code. As per the prosecution case, the altercation took place between the parties due to parking of rickshaw. It is also alleged that all the accused persons entered in the courtyard of informant and co-accused Vijay Rai assaulted on the head of informant's son by means of Iron rod and this petitioner is alleged to have disrobed the wife of informant. Both parties are on litigating term. The present case has been lodged in retaliation to Darbhanga Town P.S. Case No.

Patna High Court CR. MISC. No.5124 of 2023(2) dt.07-04-2023 2/2 245 of 2020 which was lodged by the petitioner against present informant and his associates. It is only when, the petitioner refused to compromise the earlier case, this false and concocted case has been lodged. The petitioner claims clean antecedent. Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Darbhanga, in Darbhanga Town P.S. case no.204 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
