JUSTICE SUDHIR SINGH ORAL ORDER 12-08-2015 The petitioner is languishing in custody since 29.06.2013 in connection with Piro P.S. Case No. 159 of 2013 for the offences instituted under Sections 304(B)/34 of the I.P.C. and 3⁄4 of the D. P. Act.
Heard learned counsel for the petitioner and learned counsel for the State.
The accusation is of killing the daughter of the informant after two months of marriage for non-fulfilment of dowry demand.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 29.06.2013 and the charge sheet has already been submitted in the present case. It is further submitted that the petitioner has falsely been implicated in the present case
Patna High Court Cr.Misc. No.23498 of 2015 (3) dt.12-08-2015 2/2 due to mistake of fact.
On behalf of the State it has been submitted that the petitioner is the husband of the deceased and he is named in the F.I.R.
Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected in Piro P.S. Case No. 159/2013, pending in the court of the learned C.J.M., Bhojpur at Ara. Anyhow, the trial court is directed to take all necessary steps to expedite the trial of the present case as the petitioner is in custody since 29.06.2013 and try to conclude the same preferably within a period of nine months from the date of receipt/production of copy of this order.
