2. Heard the learned counsel for the parties.

3. Certain dues of the petitioner have not been paid to him as yet. Learned counsel for the petitioner has drawn the attention of this Court to a letter addressed to the District Magistrate, Muzaffarpur by the Executive Engineer, Building Construction Department, Muzaffarpur requesting him to release fund for payment of work which has been executed by the petitioner.

4. It has been submitted on behalf of the petitioner that he would be satisfied if he is permitted to make a representation before the District Magistrate, Muzaffarpur (respondent no. 2) within a period of four weeks, detailing his grievances and the concerned respondent be asked to dispose of such representation of the petitioner.

5. Should such a representation be filed within a period of four weeks from today, the same shall be disposed of by the District Magistrate, Muzaffarpur (respondent no. 2) within a further period of four weeks thereafter.

6. This Court has made it very clear that only if the claim of the petitioner is found to be tenable/admissible, then only any order need be passed.

7. With the aforesaid direction/observation, the writ petition is disposed of.
