Petitioners apprehend their arrest in a case registered for the offence punishable under sections 363, 366 (A) and 34 of the Indian Penal Code and section 8 and 12 of Protection of children from Sexual Offences Act.

The allegation against the petitioners is that they kidnapped minor daughter of the informant to solemnize her marriage with one Lalit Kumar.

Learned counsel for the petitioners submits that accused made in this case only because they are the parents of said co-accused Lalit Kumar. Statement of the victim was

Patna High Court CR. MISC. No.5048 of 2023(2) dt.07-04-2023 2/2 recorded under section 164 Cr.P.C., in which she has not supported the prosecution case. Petitioners have got no criminal antecedent.

Learned APP for the State opposed the prayer for bail. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned ADJ-VI, cum special judge POCSO DistrictSaharsa in Sonbarsa Raj P.S. Case No. 142 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
