Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 376, 313, 323, 506/34 of the Indian Penal Code and 3(b) (w) (1) of the S.C./S.T.(Prevention of Atrocities) Act.

The prosecution case is that the son of the petitioner Abhinav Kumar established physical relationship with the informant on promise of marriage and subsequently got the pregnancy terminated. It is alleged against the petitioner that petitioner abused the informant by calling caste name.

It is submitted by the learned counsel for the petitioner that specific accusation is against Abhinav Kumar. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

Patna High Court Cr.Misc. No.14990 of 2016 (2) dt.11-04-2016 The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Mahila P.S. Case No. 05 of 2016, pending in the court of learned Chief Judicial Magistrate, Madhepura.
