JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Dhanha P.S. Case No. 36 of 2019, registered under Sections 396, 353, 307, 364 and 436/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that although the petitioner is named in the F.I.R., but more or less having similar situated co-accused have already been granted bail vide Annexure-2 and 3 series. Further submission is that this petitioner along with other co-accused were voluntarily surrendered before the District Administration along with their arms and ammunitions to live in the main stream

Patna High Court Cr.Misc. No.13578 of 2016 (2) dt.07-04-2016 2/2 of the society, which would appear from Annexure-4 First Information Report of Bagha P.S. Case No. 449 of 2013. The petitioner is in custody in the present case since 17.12.2013. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 2nd Addl. Sessions Judge, Bagaha, in connection with Dhanha P.S. Case No. 36 of 1995 (S.T. No. 65(B) of 1998). Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner and further to give the correct address of the petitioner in case of the change of the address.
