The petitioner seeks bail in anticipation of his arrest in connection with Hajipur Town P.S. Case No. 261 of 2019 instituted for the offences under Section 414 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act. Few persons were apprehended while moving in a suspicious circumstance. From one of them, a country made pistol was recovered. The name of the petitioner has transpired in the statement of one Anarjeet Kumar, from whose possession, a fire arm weapon was recovered.

The petitioner is none else but the father of the aforesaid Anarjeet Kumar.

Thus, for all practical purposes, it has been urged

Patna High Court CR. MISC. No.15359 of 2021(2) dt.04-01-2022 2/2 that the implication of the petitioner in the present case is on the basis of confession and that also by his son. It appears that the police, in order to anyhow frame the entire family of Anarjeet Kumar, has chosen to implicate his father namely the petitioner also.

The petitioner does not have criminal antecedent. Regard being had to the facts afore-stated, the petitioner, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 261 of 2019, subject to the condition as laid down under Section 438

(2) of the Code of Criminal Procedure.

The application stands allowed.
