JUSTICE SANDEEP KUMAR ORAL ORDER 16-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Amdabad P.S. Case No. 218 of 2022, registered for the offence punishable under Sections 363, 366(A) of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and falsely been implicated in this case. Petitioner has no criminal antecedent. Victim girl in her statement u/s 164 Cr.P.C. stated that both of them love each other. Petitioner had not kidnapped the minor girl. Petitioner is in custody since 25.09.2022.

Learned APP has vehemently opposed the prayer for bail.

Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special court J.M. 1st Class, Katihar in connection with Amdabad P.S. Case No. 218/2022.
