The petitioner seeks bail in Kotwali (Barari) P.S. Case No. 606/2017, instituted for offences under Section(s) 452, 341, 323, 342, 385, 397, 307, 354(B), 504, 506, 147, 148, 149 of the Indian Penal Code read with Sections 25(1-b)a, 26, 27 and 35 of Arms Act.
Learned counsel for the petitioner has submitted that there is general and omnibus allegation against this petitioner. It is alleged in the written report that on the date of occurrence while informant was sitting, petitioner along with other accused persons started abusing and looking for Mantu Yadav. They entered into house of informant and committed
Patna High Court Cr.Misc. No.3250 of 2019(2) dt.24-01-2019 2/2 vandalism. They also demanded Rs. 5,00,000/- from informant as Rangdari. The petitioner is alleged to have taken away gold and other ornaments as well as Rs. 10,000/- from possession of informant.
The other accused persons have already been granted bail by different Benches of this Court in Cr. Misc. Nos. 11919/2018 dated 27.02.2018 and 12634/2018 dated 05.04.2018.
Petitioner is in custody since 11.07.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Barari) P.S. Case No. 606/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
