The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 420 and 120B of the Indian Penal Code.

Petitioner was Manager of Canara Bank, Gaya Branch. In the said Branch, the complainant and his father Subodh Kumar Choudhary were holding a joint bank account operative by either or survivor. On the request of father of the complainant, the bank issued a draft of Rs.89,00,000/- (rupees eighty nine lakh). In the circumstance, a cheque of

Patna High Court Cr.Misc. No.5250 of 2019(2) dt.30-01-2019 2/2 Rs.21,00,000/- (rupees twenty one lacs) issued by the complainant in favour of Devi Prasad Singh bounced. Father of the complainant is also an accused in this case. Considering the entire facts, no fault of the petitioner is apparent as father of the complainant was competent to operate the bank account with equal power as that of the complainant, hence, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Complaint Case No.

1768 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
