The petitioner is languishing in custody since 12.03.2015 in a case registered for the offences punishable under sections 461/379 and 411 of the Indian Penal Code. Several deities and ornaments were stolen from a temple leading to registration of FIR against unknown. Subsequently, some of the stolen articles were recovered from the car in which five persons including the petitioner were traveling. The car was found registered in the name of the petitioner.

It is submitted by learned counsel for the petitioner that few persons took lift on the way and the stolen articles recovered from their belongings. The petitioner has never been

Considering the facts that petitioner has never been accused in similar nature of offence and investigation has already concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Nokha P.S. Case No.36 of 2015.
