The petitioner seeks regular bail in connection with Obra P.S. Case No. 258 of 2018 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The allegation is regarding recovery of 328 litres of illicit liquor from near the house of the petitioner and 864 litres of illicit liquor from a truck parked on the road not belonging to the petitioner.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is submitted that since the petitioner has a bad antecedent inasmuch as three other criminal cases are pending against the
Patna High Court Cr.Misc. No.3363 of 2019(2) dt.25-01-2019 2/2 petitioner, the petitioner is ready for being imposed such conditions as this Court may deem fit and proper for the purposes of grant of bail. It is submitted that the petitioner is languishing in custody since 12.12.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII-cumSpecial Judge (Excise),Aurangabad in connection with Obra P.S. Case No. 258 of 2018.
It is further directed that in case the petitioner is apprehended henceforth and implicated in similar type of cases, the present privilege of bail shall stand cancelled automatically. (Mohit Kumar Shah, J) S.Sb/- U T
