JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 The petitioner is languishing in custody since 01.02.2013 in connection with Raxaul P.S. Case No. 24 of 2013 for the offences instituted under Sections 20, 22, 23 and 24 of the N.D.P.S. Act.
Heard learned counsel for the petitioner and learned counsel for the State.
It is alleged that on search 60 Kgs of Ganja was recovered from possession of the petitioner.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 01.02.2013 and the trial has already in progress and as many as two witnesses have already been examined in the present case.
Patna High Court Cr.Misc. No.25413 of 2015 (2) dt.21-07-2015 2/2 On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner. The same is rejected in Raxaul P.S. Case No. 24/2013, giving rise to NDPS Case No. 23 of 2013 pending in the court of the learned 1st Additional District & Sessions Judge, East Champaran at Motihari, with a direction that the learned trial court shall take all necessary steps to conclude the trial within a period of six months.
