The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 504, 384 and 34 of the Indian Penal Code. Prosecution case is that the informant and his brother purchased six katha of land in 1990 to 1993 and during fencing of the land the accused persons came and demanded extortion. On protest being made the petitioner assaulted on the head of the informant with iron rod.
It is submitted by learned counsel for the petitioner that in the background of land dispute the accusation has been levelled.
Mr. Ambika Bhagat, learned special PP submits that
Patna High Court Cr.Misc. No.14267 of 2016 (2) dt.01-04-2016 2/2 there is specific accusation of assault.
The aforesaid facts constitute ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner keeping in view of the fact the in the background of land dispute and pending title suit the accusation has been levelled, if the petitioner surrenders within a period of six weeks in connection with Ara Town P.S. Case No.138/2016, pending before the learned CJM, Bhojpur at Ara. With the above observation, this application is, accordingly, disposed off.
