2. The petitioner seeks regular bail in connection with Bhargama P.S. Case No. 188 of 2023 registered on 10.07.2023 lodged under Sections 341, 323, 324, 307, 447, 354B, 379, 504, 506/34 of the I.P.C.

3. As per the prosecution case, F.I.R. has been lodged against seven named accused persons including the petitioner to whom allegation is that they have gathered in the court-yard of the informant and started abusing and beating the informant. The allegation against the petitioner is that he has assaulted the informant with iron rod.

4. Counsel further submits that petitioner is innocent and has committed no offence. He further submits that both

Thereafter, case and counter case has been filed. Informant has filed Bhargama P.S. Case No. 188 of 2023 from the petitioner side Bhargama P.S. Case No. 189 of 2023 has been filed

5. Counsel further submit that petitioner is in custody since 27.10.2023 having no criminal case pending against him.

6. Learned counsel for the State opposes the prayer for bail.

7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail and on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Araria in connection with Bhargama P.S. Case No. 188 of 2023, subject to the conditions laid down under Section 437 (3) of the Cr.P.C.
