2. The petitioner apprehends his arrest in connection with Azamnagar P.S. Case No. 59 of 2024, registered for the offences punishable under Sections 366(A) of the IPC.

3. As per allegation, the petitioner kidnapped the minor daughter of the informant for the purpose of marriage.

4. The learned counsel for the petitioner has submitted that there is love and affection between the petitioner and the alleged victim. In her statement recorded under Section 164 of the CrPC, the victim has supported the prosecution case. However, in the same statement recorded under Section 164 of the CrPC, she also stated that she went with her parents. He has further submitted that the age of the victim has been mentioned as 18 years in her statement recorded under Section 164 of the CrPC. He has also submitted that

Patna High Court CR. MISC. No.5775 of 2025(4) dt.11-09-2025 2/2 the informant realized her mistake and filed a compromise petition in the court below and a certified copy of the compromise petition is annexed with the record as Annexure-2.

5. On the other hand, learned APP for the State has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Katihar in connection with Azamnagar P.S. Case No. 59 of 2024, subject to the conditions as laid down under Section 438(2) of the CrPC/482(2) of the BNSS, 2023.

7. The office is directed to send the xerox copy of the compromise petition (Annexure-2) to the court below for its verification.
